Illegal charters occur when an aircraft operates for compensation outside FAA regulations. Common violations include using dry leases to disguise illegal charter operations, selling individual seats without proper Part 135 or Part 380 certification, and misusing fractional ownership arrangements to fly non-owners for profit.
THE REAL RISKS
Operational Control: The FAA defines "Operational Control" of an aircraft as "the exercise of authority over initiating, conducting or terminating a flight." On an illegal charter, this responsibility falls squarely on the lead passenger.
